SIMPLY CREATIVE BIRTHDAY PARTIES CONTEST
OFFICIAL CONTEST RULES

The Simply Creative Birthday Parties Contest (the "Contest") is sponsored by Simply Creative Publishing, LLC (the "Sponsor"). By entering the Contest, you agree to comply with and be bound by the following official Contest rules (the "Rules").  Please review the Rules carefully.  If you do not agree to the Rules in their entirety, you are not permitted to enter the Contest.

1. NO PURCHASE NECESSARY TO ENTER OR WIN.

2. Eligibility.
This Contest is open to legal residents of the United States and the District of Columbia, living in the United States or the District of Columbia who are at least 18 years of age. The Contest is void in Puerto Rico, Rhode Island and in any other jurisdiction where the Contest is prohibited or otherwise restricted by law, rule or regulation. The Sponsor, employees and independent contractors of the Sponsor, the judges and their immediate families (and those living in the same households) are not eligible to enter the Contest.

Entrants wishing to obtain a copy of these Rules may request a printed copy through the Contact Us page.

3. How To Enter.
Visit the website (http://www.simply-creative-birthday-parties.com/contest-submission-page.html) and follow the directions provided on the entry page to fill out the entry information and submit each entry.

Each entry MUST contain an original write-up describing the party. The party description MUST be original and cannot be copied from any source whatsoever.

A submission may only be entered once.

Please note that due to the labor intensive process of evaluating the write-ups and ideas, there may be delays in approving party submissions.

By submitting your birthday party write-ups and ideas, you grant Simply-Creative-Birthday-Parties.com an exclusive perpetual license to re-publish, alter and create derivatives of your submission.

4. How to Win.
Sponsor in its sole and absolute discretion will judge entries using the following criteria: (1) creativity; (2) originality of the ideas; (3) quality and completeness of description.

The winner will be notified no later than the 10th day of the following calendar month via email. By participating, entrants agree to the Official Rules and the decisions of the judges, which shall be final and binding in all respects.

Winners will be notified via electronic mail within one week of the drawing that they are the winner of the individual contest.  It is your sole responsibility to ensure that you check your email and that the email address that you have provided is accurate and current.  We highly suggest that you “whitelist” the email address that you receive from us when you register as a member so that you can avoid winner’s emails inadvertently being diverted by your spam filter.  Winners are subject to eligibility verification.

It is the winner’s responsibility to respond to the Company by to claim their prize within ten (10) calendar days of Sponsor sending notification email.  In no case shall the Sponsor be liable in any manner where a winner has not seen the email sent by the Company and / or the Company fails to receive contact from the winner within ten (10) days. If a response is not received from the winner within ten (10) calendar days, the Winner will forfeit their prize and the Company will randomly select another winner.

6. Prize Descriptions.
Each monthly prize shall be posted on the entry page of the individual month’s contest. 

7. Odds of Winning.
The odds of winning depend on the number of Entrants who have submitted, as defined in Section 3 above.

8. Limited Time.
The Contest period begins on the first day of each month (12:00 am EST) and ends on the last day of each month (11:59 pm EST).

9. Winners List.
To receive a list of winners, please request them through the Contact Us page.

10. Taxes.
All federal, state and local taxes, and all similar fees and assessments, are the responsibility of the winner.

11. International Users.
By entering in the contest, you understand and agree to be subject to the laws of the United States of America in accordance with these rules.  This contest is void where prohibited by law.

To the extent permitted by law, the right to litigate, to seek injunctive relief or to make any other recourse to judicial or any other procedure in case of disputes or claims resulting from or on connection with this Contest are hereby excluded and you expressly waive any and all such rights.

12. No Substitution.
No substitution or transfer of prizes will be accommodated or permitted, other than in the sole discretion of the Sponsor.
 
13. Publication.
Contest entry constitutes permission for Sponsor to use Entrants' names and likenesses for advertising and promotional purposes without further compensation, except where prohibited by law.

By entering this Contest, Entrant warrants that his or her entry is entirely his or her own original work and that he or she has the sole and exclusive rights to submit said entry to the Contest and to permit the Sponsor to reprint the entry.

14. Release.
By entering the Contest, each Entrant agrees to release and hold harmless the Sponsor, employees and independent contractors of the Sponsor, their legal representatives, their affiliates, subsidiaries, parents, agencies and their respective officers, directors, employees and agents from any and all liability for any injuries, loss or damage of any kind arising from, or in connection with, the Contest including, but not limited to, liability arising from improper use of likeness, improper use of copyrighted materials, personal injury, death, damages or monetary loss. Restrictions, conditions and limitations apply.

By entering, each Entrant further agrees that, in the event that there is any conflict or other inconsistency between the Rules and any advertisements, promotional or marketing materials, e-mails or announcements relevant to the Contest, these Rules will govern. Any disputes arising from the Promotion shall be governed by and construed in accordance with the laws of the State of New York (without regard to conflict of law principles). Should a dispute arise concerning the Contest, the parties agree to submit their dispute for resolution in a court of competent jurisdiction in the State of New York. Should any part of these Rules be held invalid or unenforceable, that portion shall be construed consistent with applicable law and the remaining portions shall remain in full force and effect.

15. Disqualification.
The Sponsor, the judges, employees and independent contractors of the Sponsor, their legal representatives, their affiliates, subsidiaries, parents, agencies and their respective officers, directors, employees and agents, are not responsible for lost, interrupted or unavailable network server or other connections, miscommunications, failed telephone or computer transmissions or technical failure, lost online entries, jumbled, scrambled or misdirected transmissions, or other error of any kind, whether human, mechanical or electronic. Persons found tampering with or abusing any aspect of the Contest, as solely determined by the Sponsor, will be disqualified.

If disqualified for any of the above reasons, we reserve the right to terminate Entrant's eligibility to participate in the Contest. In the event that any portion of the Contest is compromised by virus, bugs, non-authorized human intervention or other causes beyond the control of the Sponsor which, in the sole opinion of the Sponsor, corrupts, or impairs the administration, security, fairness or proper determination of the Contest, the Sponsor reserves the right, in its sole discretion, to suspend or terminate the Contest or any part of the Contest, or any combination of the above. The Sponsor is not responsible for any problem with entries generated by computer hardware or software malfunction, error or failure, whatever the cause.

16. Legal Warning.
Any attempt by any individual, whether or not a Entrant, to damage, destroy, tamper with or vandalize the Contest Website, or otherwise interfere with the operation of the Contest, is a violation of criminal and civil law and the Sponsor will diligently pursue any and all remedies in this regard against any offending individual or entity to the fullest extent permissible by law and in equity.

Your submission to this site must be original and created by you (not copied), in good taste, legal, accurate and true, non-defamatory, non-threatening, non-confidential, non infringing of copyrights owned by others and relevant for this site.

Please do not enter HTML (it will be converted to text) or ALL CAPS (they will be converted to lower case).

Your submission should be non-commercial/non-promotional in nature and should not contain commercial web addresses, e-mail addresses or phone numbers.

simply-creative-birthday-parties.com reserves the right to reject your submission, or to edit/delete any parts of it that violate this Agreement, including the right to ban violators from submitting again. simply-creative-birthday-cakes.com may also edit to improve clarity (ex. typos).

I certify that I have the right to submit the text that I am submitting. My submission signifies agreement to the above and that I  agree to grant to simply-creative-brthday-parties.com an exclusive, royalty-fre, irrevocable, transferable, perpetual license to publicly display my submission on simply-creative-birthday-parties.com. Submission of write-ups is on an non-exclusive basis. I grant simply-creative-birthday-parties.com the right to pursue anyone who copies my submission.
